Overview

These Terms of Service ("Terms") govern your use of the PairIQ mobile application ("App") operated by PairIQ ("we," "our," or "us"). By downloading, installing, or using PairIQ, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App

1. Acceptance of Terms

By accessing or using PairIQ, you confirm that you are at least 13 years of age (or 16 years of age if you are located in the European Economic Area), that you have read and understood these Terms, and that you agree to be bound by them. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

PairIQ is a nutritional pairing intelligence application that provides information about how foods interact at a nutrient absorption level. The App allows users to:

  • Search foods and view nutritional pairing information

  • Build meals and receive absorption scores

  • Discover optimized meal combinations

  • Track meal history and absorption trends over time

  • Receive supplement timing guidance based on meal content

PairIQ is provided on a freemium basis. Core features are available free of charge. Premium features are available through a paid subscription as described in Section 7.

3. Health and Medical Disclaimer

This is the most important section of these Terms. Please read it carefully.

PairIQ provides general nutritional information for educational purposes only. PairIQ is not a medical application and is not intended to replace professional medical advice.

Not medical advice. The content provided by PairIQ, including food pairing scores, absorption estimates, supplement timing suggestions, and nutritional insights, is for general informational purposes only. It does not constitute medical advice, diagnosis, or treatment.

Not a substitute for professional care. Always seek the advice of a qualified physician, registered dietitian, or other qualified healthcare provider with any questions you may have regarding your diet, health condition, nutritional needs, or supplement use. Never disregard professional medical advice or delay seeking it because of information you received from PairIQ.

Not a medical device. PairIQ is not approved or cleared by the U.S. Food and Drug Administration (FDA) or any other regulatory body as a medical device or diagnostic tool.

Supplement interactions. The supplement timing information provided by PairIQ is based on general nutritional science and is not personalized medical guidance. Individual responses to supplements vary. Consult your healthcare provider before starting, stopping, or changing any supplement regimen.

Nutritional science limitations. Nutritional science is an evolving field. The information in PairIQ reflects current peer-reviewed research but may not account for individual variation, emerging research, or specific health conditions.

By using PairIQ, you acknowledge and agree that PairIQ is not responsible for any health outcomes, adverse effects, or decisions made based on information provided by the App.

4. User Responsibilities

You agree to:

  • Use PairIQ for lawful purposes only

  • Not attempt to reverse engineer, decompile, or extract the source code of the App

  • Not use the App in any way that could damage, disable, or impair the App or its servers

  • Not attempt to gain unauthorized access to any part of the App or its infrastructure

  • Provide accurate information when using the App's features

  • Consult a qualified healthcare professional before making significant dietary or supplement changes based on information from the App

5. Intellectual Property

All content within PairIQ, including but not limited to the nutritional database, pairing algorithms, scoring systems, design, graphics, text, and code, is the property of PairIQ and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use. This license does not include the right to:

  • Copy, modify, or distribute any content from the App

  • Use the App's content for commercial purposes

  • Create derivative works based on the App's content or functionality

6. User Data

All personal data generated through your use of PairIQ — including meal history, saved meals, preferences, and supplement information — is stored locally on your device. You retain full ownership and control of this data at all times.

PairIQ collects anonymous usage analytics through PostHog to improve the app experience. This data is not linked to you as an individual and does not constitute personal data as defined under applicable privacy law. See our Privacy Policy for full details.

PairIQ does not claim any ownership rights over data you create within the App. You may delete your locally stored data at any time through Profile → Data & Privacy.

7. Subscriptions and Payments

PairIQ offers a premium subscription ("PairIQ Pro") that unlocks additional features including expanded meal builder capacity, unlimited Discover meals, full history access, and supplement timing.

  • Pricing: Monthly at $9.99/month or Annual at $59.99/year, billed through the Apple App Store

  • Free trial: If offered, the terms of any free trial will be clearly disclosed before activation

  • Billing: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period

  • Cancellation: You may cancel your subscription at any time through your Apple ID account settings under Subscriptions. Cancellation takes effect at the end of the current billing period

  • Refunds: Refunds are subject to Apple's App Store refund policy. PairIQ does not process refunds directly

  • Price changes: We reserve the right to modify subscription pricing with reasonable advance notice. Continued use after a price change constitutes acceptance of the new pricing

  • Restore purchases: You may restore a previously purchased subscription through the Restore option in the app's paywall screen

8. Disclaimer of Warranties

PairIQ is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose

  • Warranties that the App will be uninterrupted, error-free, or secure

  • Warranties regarding the accuracy, completeness, or reliability of any nutritional information

  • Warranties that the App will meet your specific requirements or health goals

Nutritional absorption values and scores provided by PairIQ are estimates based on population-level research and may not reflect your individual response.

9. Limitation of Liability

To the fullest extent permitted by applicable law, PairIQ and its owners, officers, employees, and affiliates shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages

  • Any loss of health, physical harm, or adverse medical outcomes resulting from use of the App

  • Any decisions made based on nutritional information provided by the App

  • Any loss of data resulting from device failure or app malfunction

  • Any damages exceeding the amount paid by you for the App in the twelve months preceding the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless PairIQ and its owners, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of another party.

PairIQ uses the following third-party services:

PairIQ is not responsible for the practices, content, or availability of any third-party services. Your use of these services is subject to their respective terms.

12. Modifications to the App and Terms

We reserve the right to:

  • Modify, suspend, or discontinue any part of the App at any time with or without notice

  • Update these Terms at any time by posting the revised Terms at pairiqapp.com/terms

Material changes will be indicated by an updated "Last Updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the App shall first be addressed through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, it shall be submitted to binding arbitration in the State of Florida in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

EU Users: If you are located in the European Union, you may also be entitled to bring a claim before the courts of your country of residence or the courts of the country where PairIQ is established, in accordance with applicable EU consumer protection law.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy at pairiqapp.com/privacy, constitute the entire agreement between you and PairIQ regarding your use of the App and supersede all prior agreements and understandings.
